The municipal electric light plan of the city, shall be under the control of the governing body and it shall maintain and keep the light plant in good repair.

The governing body shall hire and discharge all laborers necessary to operate and maintain the plant. One of the employees shall be designated as the superintendent of the municipal electric department.

Any person or persons desiring to install electric light or power must notify the superintendent, stating the amount of light or power to be installed before service wires will be connected with the city’s main wire.

No person or persons, except the regular city utility employees, shall be permitted to connect any utility lines with the city’s light wires. It shall be the duty of the superintendent of electric utilities to file complaint in court against any person or persons violating any section of this article.

The governing body shall adopt such rules and regulations in conformity herewith as may be deemed necessary, and shall see that all rules and regulations and the provisions of this article are strictly enforced.

(a) Beginning with meter readings on or after the 1st day of October 2018, the rates and conditions hereinafter provided shall apply to all electrical service purchased from the City. All meters, for all classes of users shall be read and billed on a monthly basis.
(b) CAPACITY CHARGE: In addition to the Base Rate, ENERGY and Meter Charge, the City shall bill monthly to interconnected distributive generation customers costs associated with balancing supply and demand to maintain a stable frequency (i.e., regulation service); providing the capacity to stand ready to supply the distributive generation customer; providing grid service; reselling energy during hours of excess generation; delivering energy during hours of deficit generation; providing the energy needed to serve the customer’s total load during times when on-site generation is inoperable due to equipment maintenance, unexpected physical failure, or prolonged overcast conditions (i.e., backup service); providing voltage and frequency control services and maintaining high AC waveform quality. The following formula shall be used for calculating the capacity charge:

(c) ENERGY CHARGE: In addition to the Base Rate and Meter Charge, the City shall bill monthly the actual cost of the City’s wholesale power charges, all actual city generation costs, transmission charges, and any other associated costs of delivering energy. (d) “City Losses” are defined as energy supplied for municipal purposes, unmetered energy provided for recreational purposes, and line losses calculated according to the following formula and expressed in terms of a percentage:

(e) City Losses shall be calculated on an annual basis and billed equally overall customer service classifications on a prorated monthly basis.
(f) In determining the appropriate rate for Commercial Service customers, an annual year shall be deemed to begin from the first date of service. For existing customers, an annual year shall be deemed to begin on January 1st.
(g) In determining the appropriate rate for Commercial Service customers, City staff are authorized to make projections of energy use based on prior service at the same location or based on the first six months of actual energy usage. Adjustments to rate classifications and billings shall be made on a semi-annual basis by City staff based on actual energy usage.

(a) Total Electric Residential Service shall be provided to all residential customers who use electricity as the sole source of energy in their residence and ancillary buildings. To qualify for the total electric rate, the residence and ancillary buildings must use electricity as the primary source of heat. The following major appliances must also derive their sole source of energy consumption from electricity: range/stove; clothes dryer and water heater. Fireplaces and or heating stoves which burn another fuel will be allowed only if there is no form of forced ventilation or circulation of heat. To receive this rate customer are required to sign a contract with the City for a term of not less than 12 months. As a condition of qualifying for the total electric residential rate, the customer shall allow an inspection of the residence and outbuildings by designated utility employees of the City at least annually upon request during normal business hours of the City.
(b) Type of Service Available. Single phase, 60 cycles, at available voltage.
(c) Total Electric Residential Rate Inside Limits Schedule. Base Rate: $0.056/kWh plus Energy Charge. All kWh over 1,500 kWh: $0.04/kWh plus Energy Charge during the billing months of January, February, March, and April.
(d) Total Electric Residential Rate Outside Limits Schedule. Base Rate: $0.066/kWh plus Energy Charge. All kWh over 1,500 kWh: $0.05/kWh plus Energy Charge during the billing months of January, February, March, and April.
(e) Residential Meter Charge Inside City: $15.00 per month. Residential Meter Charge Outside City: $20.00 per month.

Commercial Service shall be provided to all customers except residential, total electric residential, large commercial, and governmental entities.
(a) Small commercial service.
(1) Small Commercial Service shall be provided to all customers using 47,999 kWh or less on an annual year basis.
(2) Type of Service Available.

(3) Small Commercial Service Rate Inside City Limits Schedule.
Base Rate: $0.062/kWh plus Energy Charge
(4) Small Commercial Service Rate Outside City Limits Schedule.

(5) Small Commercial Meter Charge Inside City: $25.00 per month

(b) Commercial service
(1) Commercial Service shall be provided to all customers using 48,000 kWh to and including 359,999kWh on an annual year basis.
(2) Type of Service Available.

(3) Commercial Service Rate Inside City Limits Schedule.

(4) Commercial Service Rate Outside City Limits Schedule.

(c) Large commercial service
(1) Large Commercial Service shall be provided to all customers using 360,000 kWh or more on an annual year basis through a single meter, except as hereinafter provided.
(2) Type of Service Available.
Three-phase, 60 cycles, at available voltage.
(3) Large Commercial Service Rate Inside City Limits Schedule.
Base Rate: $0.034/kWh plus Energy Charge
(4) Large Commercial Service Rate Outside City Limits Schedule.
Base Rate: $0.044/kWh plus Energy Charge
(5) Large Commercial Meter Charge Inside City: $25.00 per month
Large Commercial Meter Charge Outside City: $30.00 per month
(6) Large Commercial Service is not available to Governmental entities.
(7) At the time of the passage of Ordinance No. 1219, the following customers have been allowed to aggregate their electrical usage through multiple meters at the same geographical location for the purpose of determining total usage to qualify for the Large Commercial Service rate:
ETCO Manufacturing, FMI, Craw Kan Telephone Cooperative Association, Inc., DEN CO Aluminum, Producers Cooperative Association, and Cenveo.
The aforementioned customers and only those customers shall be allowed to aggregate their electrical usage through multiple meters at the same geographic location for the purpose of determining total usage to qualify for the Large Commercial Service rate.

(a) Governmental Service shall be provided to all governmental entities. Those customers shall include the Girard Medical Center, Unified School District 248, the State of Kansas or agencies thereof, and Crawford County, Kansas and agencies thereof.

(c) Governmental Service Rate Inside City Limits Schedule.
Base Rate: $0.041/kWh plus Energy Charge

Governmental Service Meter Charge Outside City: $30.00 per month
(f) Governmental Service Customers are not entitled to any other rate other than as provided by this Section 15-311.
