The mayor shall appoint, by and with the consent of the council, a chief of police and may appoint by and with the consent of the council, police officers as deemed necessary.

It shall be the general duty of the chief of police and all sworn law enforcement personnel to the best of their ability to preserve good order, peace and quiet throughout the city as provided by law or ordinance.
The chief of police and all sworn law enforcement personnel shall at all times have power to make arrest under proper process or without process on view of any offense against the laws of the State of Kansas or laws of the city and to keep all persons so arrested, unless admitted to bail, in the city jail, county jail or other proper place to prevent their escape until their trial can be had before the proper officer.
All persons arrested for violation of any law of the state and who shall not be charged with an offense under any law of the city shall be released to the custody of the sheriff of the county and such arrest shall be reported to the county attorney.

The chief of police shall have power to make such rules and regulations as may be necessary for the proper and efficient conduct of the department. Such rules and regulations shall be approved by the governing body.

The assistant chief of police shall be appointed by the mayor with the advice and consent of the city council. No person may be appointed to the position of assistant chief of police unless such person has a minimum of one-year experience in law enforcement and has completed the prescribed course of the Kansas Law Enforcement Academy as required by law.

In the absence of the chief of police, the assistant chief of police shall perform all the duties and have all the authority and responsibility of the chief of police as conferred by the laws of the State of Kansas and the ordinances of the city.

The officers of the city police department are authorized to participate and cooperate with any law enforcement officers of jurisdictions in any major case squad operation or formation. Those officers designated to act as members of a major case squad operation or county-wide drug task force will be so designated by the chief of police and when acting outside of the city as members of the major case squad operation such officers shall be considered to be on active duty the same as they would be if acting on their regular duties within the boundaries of the city.

(a) For the purpose of this section, the term emergency situation shall mean any unforeseen combination of circumstances or events involving danger to human life or property which requires immediate action.
(b) The officers of the city police department are authorized to respond to any emergency situation outside the boundaries of the city. The officers responding will be designated by the chief of police and when acting outside of the city in an emergency situation such officers shall be considered to be on active duty the same as they would be if acting on their regular duties within the boundaries of the city.
