The Standard Traffic Ordinance as adopted is hereby modified by adding thereto the following:

(a)   The governing body may, by resolution, establish and fix the location of such traffic control devices as may be deemed necessary to guide and warn traffic under the provisions of this chapter, other traffic ordinances and the state laws. The city shall place and maintain such traffic control signs, signals and devices when and as may be required by the authority of the governing body to make effective the provisions of this chapter and other ordinances for the regulation of traffic. Any official traffic control device placed pursuant to this section shall be marked and labeled on a map of the City of Girard for the purpose of displaying all such traffic control devices and shall be filed with the city clerk to be open to inspection and available to the public at all reasonable hours of business.

(b)   The penalty for a violation of any provision of this chapter, other ordinances for the regulation of traffic, local traffic regulations, and ordinances for which no other penalty is established, shall be the assessment of a fine by the Municipal Judge in an amount not less than $50.00 nor more than $1,000.00 plus applicable court costs as provided by law.

The Standard Traffic Code of the city is hereby amended by the re-titling of Article 15 and repealing Section 136 by adding Section 136-01 through 136-08 which reads as follows:

(a)   Article 15 is hereby amended to read Operation of Bicycle, Motorized Bicycle, Low Power Cycles, Play Vehicles, Skateboards, Roller Skates, and Inline Skates.

(b)   Section 136-01. Definitions –For the purpose of this article certain items and words are hereby defined:

(1)   Roller Skates and Inline Skates mean small wheels near the toe and the heel of a shoe or frame that would attach to a shoe which are used for gliding on a hard surface such as a floor, sidewalk, etc.

(2)   Skateboards refers to an item consisting of a short, oblong board with small wheels at each end, ridden on a hard surface such as floors or sidewalks.

(3)   To Roller Skate means to skate on any type of roller skates or inline skates.

(c)   Section 136-02. Roller Skates, Inline Skates and Skateboards Regulated -No person shall roller skate or ride a skateboard within the city without complying with the terms of this article.

(d)   Section 136-03. Skating or Riding on Sidewalks-Whenever any person is roller skating or riding a skateboard upon a sidewalk or other paved surface intended for use by pedestrian, such person shall yield the right-of-way to any pedestrian and shall not approach, overtake, or pass such pedestrian in a reckless or careless manner, and shall not pass such pedestrian except in a single file if such person is roller skating or riding a skateboard with other such skaters or riders.

(e)   Section 136-04. Skating or Riding on Certain Devices or Structures Prohibited - It shall be unlawful to roller skate or ride on a skateboard on any bench, table, planter wall, retaining wall or other device or structure in the public business sector, which is not intended for pedestrian or vehicle traffic, or to jump or step on or off such devices or structures in the process of roller skating or riding a skateboard.

(f)   Section 136-05. Reckless or Dangerous Skating or Riding Prohibited - No person shall roller skate or ride a skateboard on any sidewalk, road, or other paved surface in a reckless or careless manner, or in a manner which is likely to result in injury or harm to any person or property.

(g)   Section 136-06. Skating or Riding on Private Property without Permission Prohibited -No person shall roller skate or ride a skateboard on private property without first obtaining and carry on his or her person the written permission of the owner of the private property to allow such skating or riding. Failure of a person who has been roller skating or riding a skateboard on private property to produce such written permission, upon request of any police officer, shall constitute prima facie evidence that the person is in violation of this section.

(h)   Section 136-07. Skating or Riding Prohibited -No person shall ride a skateboard or roller skate upon the streets of the city as follows:

(1)   All of Highway K-7.

(2)   All of Highway K-47.

(3)   All of Prairie and Forest bound by Summit and Ozark.

(4)   All of Ozark bound by Prairie and Forest.

(a)   No person shall park or stand any dump truck, truck tractor, trailer or semi-trailer on any street or street right-of-way (parquet) in any area of the city zoned as residential, including R-1, R-11 and R-111 zones.

(b)   No person shall park or stand any dump truck, truck tractor, trailer or semi-trailer at the curb along or adjacent to any residential property.

(c)   No person shall stop, stand or park any dump truck, truck tractor, trailer or semi-trailer upon a street in such manner or under such conditions as to leave less than 20 feet of the width of the roadway free for full movement of vehicular traffic.

(d)   No person shall park or stand any trailer or semi-trailer which has been detached from a truck tractor on any street in the city.

(e)   No person shall park or stand any dump truck or semi-trailer on any property that is zoned as residential, including R-I, R-II and R-III zones except for those that are being used for the purpose of delivering to said residence or are being used for the purpose of demolition, construction or repair purposes for said property.

(f)   Truck-Tractors also known as Semi-Tractors (without trailers) will be allowed to park upon zoned residential property upon satisfying the following requirements;

(1)   There must exist adequate space for parking on said property off of the right-of-way and as not to impede the sight of traffic from road, alley or adjacent driveways.

(2)   Only one entrance will be allowed for the purpose of parking said semi-tractor. Entrance must be approved by the Street Department Supervisor for proper drainage, width and suitability for the given weight of said vehicle.

(3)   The driveway and parking area for said semi-tractor must consist of an all-weather surface and will be supplied with a GFI outlet at the parking area for heating purposes. Extension cords ran from house or garage will not be allowed.

It is unlawful to park any automobile or vehicle on the south side of East Forest Avenue west of the alley which runs north and south between Cherokee Street and Ozark Avenue for a distance of 90 feet from the intersection of the alley and the street, and it is unlawful to park an automobile or vehicle upon the north side of the street west of the alley for a distance of 145 feet.

Any vehicle when parked on Ozark Avenue between Prairie Avenue and Forest Avenue, on Forest Avenue between Ozark Avenue and Summit Avenue, on Summit Avenue between Forest Avenue and Prairie Avenue, and on Prairie Avenue between Summit Avenue and Ozark Avenue, shall be parked on the east and west, north and south, east and west, and north and south sides of the parts of the streets respectively, with its right front wheel to the curb at an angle of 45 degrees to the curb line. Provided, however, that all heavy grain, stock and coal trucks shall be parked on the west, south, east and north sides of the streets respectively. On all other streets in the city, with the exception of those parts of streets designated in section 15-206, a vehicle shall be parked with its right side to the curb and parallel to the curb, and not more than one foot from the curb, and not less than three feet for any other standing vehicle and shall be headed in the same direction as the traffic is headed on the side of the public highway that such vehicle is parked.

A vehicle parked on the north or south sides of Forest Avenue extending eastward from the northeast corner of the public square for the distance of the additional pavement or parking space provided thereof, shall be parked at the same angle and in the same manner as vehicles around the public square; that a vehicle parked on the west side of Ozark Avenue extending northward from the northeast comer of the public square for the distance of the additional pavement or parking space provided therefor, shall be parked at the same angle and in the same manner as herein provided for vehicles parked around the public square; that on Summit Avenue extending northward from the northwest corner of the public square, a vehicle parked on the east and west sides of Summit Avenue for distance provided for in the additional parking space on the street, shall be parked at the same angle and in the same manner as herein provided for vehicles parked around the public square; that on West Forest Avenue a vehicle parked on the south side of West Forest Avenue for a distance west of the northwest comer of the public square equal to that provided in the additional parking space, shall be parked at the same angle and in the same manner as herein provided for vehicles parked around the public square; that a vehicle parked on the east side of Ozark Avenue extending southward from the southeast corner of the public square a distance equal to that of the special parking place provided on the street, shall be parked at the same angle and in the same manner as provided for vehicles parked around the public square; that a vehicle parked on the south side of East Prairie Avenue for a distance extending eastward from the southeast comer of the public square equal to that of the special parking space there built, shall be parked at the same angle and in the same manner as is provided herein for vehicles parked around the public square.

Any vehicle when parked on the north side of Maple Street between Summit Avenue and Carbon Street shall be parked at an angle of 45 degrees, provided, however, that school buses when engaged in the transportation, taking on and letting off students may be parked parallel with the curb. Any vehicle when parked on the south side of Maple Street between Summit Avenue and Osage Street shall be parked at an angle of 45 degrees. Any vehicle when parked on the south side of Maple Street between Osage Street and Carbon Street shall be parked parallel to the curb line and not closer than three feet to any other parked vehicle.

Any vehicle when parked on the south side of Cedar Street between Carbon Street and Summit Avenue shall be parked at an angle of 45 degrees. Any vehicle when parked on the north side of Cedar Street between Osage Street and Summit Avenue shall be parked parallel to the curb line and not closer than three feet to any other parked vehicle. On the north side of Cedar Street from Carbon Street to Osage Street there shall be no par-king of automobiles or vehicles of any kind or character.

It is unlawful to park any vehicle on the north side of Forest Avenue between Ozark and Summit Avenues, on the west side of Summit Avenue between Forest and Prairie Avenues, on the south side of Prairie Avenue between Summit and Ozark Avenues, and on the east side of Ozark Avenue between Prairie and Forest Avenues for a period exceeding two hours.

Southbound buses shall be parked lengthwise and not at an angle on Ozark Avenue between Prairie Avenue and Forest Avenue and immediately to the north of the traffic lane for pedestrians running from the sidewalk on the east side of Ozark Avenue to the end of the sidewalk in the public square on the west side of Ozark Avenue. Northbound buses shall be parked on Ozark Avenue between Forest Avenue and Prairie Avenue immediately south of the traffic lane crossing Ozark Avenue, as aforesaid.

It is unlawful for any engineer, conductor or other person having under his or her charge, control or management any railway engine, car or train, to travel at a rate of speed greater than 25 miles per hour within the corporate limits of the city.

It is unlawful for any engineer, conductor or other person having under his or her charge, control or management any railway engine, car or train, to cause or permit the same to stand on or across or to obstruct any street, avenue or alley in the city for a longer period than five minutes at any one time.

As hereinafter used the term alley shall mean road or right-of-way intended to provide access to the rear or side of lots or buildings within the city and not intended for the purpose of through vehicular traffic.

No vehicle or combination of vehicles with a gross weight in excess of 12,000 pounds shall be parked, moved or operated on any alleys within the corporate limits of the city.

(a)   This article shall not apply to ambulances, emergency vehicles, service vehicles of any public utility utilized for the purpose of gaining access to its overhead or underground lines; and vehicles utilized for construction projects.

(b)   The following alleys shall be exempt from the provisions of this article for the reason that the alleys at the time of the passage of this article serve present commercial or business establishments within the city or have an all-weather surface: The alleys lying in Blocks Two, Four, Seven, Eight, Nine, Twelve, Fourteen, Seventeen, Eighteen, Nineteen, in the Original Town of Girard, according to the recorded plat thereof; Block Three in the North Addition to the city, according to the recorded plat thereof; Block One in Barker’s subdivision to the city, Blocks Two and Three of Clark’s Addition to the city according to the recorded plat thereof; Block One in South Addition to the city, according to the recorded plat thereof; and Block four in South Girard, an addition to the city, according to the recorded plat thereof.

It is unlawful to park any vehicle at the City of Girard Sports Complex parking area located at 215 E. Forest for any reasons other than for use of the Sports Complex. Any person violating any provision of such code shall be punished as provided in section 14-201 of this code.
