(a)   It shall be unlawful for any person, firm or corporation to keep, maintain or have in his or her possession or under his or her control within the city any poisonous reptile or any other dangerous wild animal or reptile, any vicious or dangerous animal or any other animal or reptile of wild, vicious or dangerous propensities.

(b)   It shall be unlawful for any person to keep, maintain or have in his or her possession or under his or her control within the city any of the following animals:

(1)   All poisonous animals including rear-fang snakes.

(2)   Apes: Chimpanzees; gibbons; gorillas, orangutans; and siamangs.

(3)   Armadillos

(4)   Baboons.

(5)   Badgers.

(6)   Bears.

(7)   Bison.

(8)   Bobcats.

(9)   Camels.

(10) Cheetahs.

(11) Civets and ringtails.

(12) Crocodilians, 30 inches in length or more.

(13) Constrictor snakes, six feet in length or more.

(14) Coyotes.

(15) Deer; includes all members of the deer family, for example, white-tailed deer, elk, antelope and moose.

(16) Dingos.

(17) Elephants.

(18) Emus.

(19) Game cocks and other fighting birds.

(20) Gila monsters.

(21) Giraffes.

(22) Hippopotami.

(23) Hyenas.

(24) Jaguars.

(25) Kangaroos.

(26) Leopards.

(27) Lions.

(28) Llamas.

(29) Lynxes.

(30) Monitor lizards.

(31) Monkeys.

(32) Mountain goats.

(33) Ocelots.

(34) Opossums.

(35) Ostriches.

(36) Pronghorns.

(37) Pumas; also known as cougars, mountain lions and panthers.

(38) Raccoons.

(39) Rhinoceroses.

(40) Skunks.

(41) Tasmanian Devils.

(42) Tigers.

(43) Vultures and other birds of prey.

(44) Wolves.

(45) Wolverines.

(46) Zebras.

(c)   Animals which are hybrids or cross breeds of any of the animals listed in subsection (b).

(d)   The prohibitions of this section shall not apply to bona fide pet shops, zoos, circuses, carnivals, educational institutions, or medical institutions, if:

(1)   Their location conforms to the provisions of the zoning ordinance of the city.

(2)   All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.

(3)   Animals are maintained in quarters so constructed as to prevent their escape.

(e)   The municipal judge shall have the authority to order any animal deemed vicious confined, destroyed or removed from the city.

Any person violating or permitting the violation of any provisions of this article shall upon conviction in municipal court, be fined a sum up to $1,000. In addition to the fine imposed the court may sentence the defendant to confinement in the county jail for a period not to exceed 30 days. Each day that a violation of this article continues may be deemed to constitute a separate offense. In addition to the forgoing penalties, any person who violates this article shall pay all expenses, including sums for shelter, food, handling, veterinary care, disposal of exotic animal and expert testimony, which are necessitated by the person’s failure to abide by the provisions of this article.
